LEGAL TERMS AND CONDITIONS OF CRUZ WINTER CAMPAIGN
1. OBJECT
In order to promote its sales and reward users, the company CRUZBER SAU (hereinafter "CRUZBER"), with CIF (VAT NR): ES-A-14018311 and with registered office at Pol. Ind. Las Salinas II plot 12, CP 14960 Rute (Spain), telephone: 0034 957 538 354 and general email address export@cruzber.com, promotes (the "Promotion") "CRUZ winter campaign - ski carriers", which will be governed by the following legal bases (the "Legal Terms and Conditions"):
2. CAMPAIGN PERIOD
The period during which you can participate in the promotion and raffle will begin on November 15st, 2022 at 00:00 (CEST) and will end on February 28th, 2023 at 23:59 (CEST).
3. TERRITORIAL SCOPE
This Promotion will be valid in Europe.
4. PARTICIPATION REQUIREMENTS
All participants must be over 18 years of age. CRUZBER employees are excluded from participating in this Campaign.
5. PRIZE
A raffle will be held among all participants who have correctly complied with the raffle rules and have registered the purchase in out Registration form.
A total of (2) Prizes are awardeded, drawn among all those who acquire and register any of our CRUZ ski carriers during the dates mentioned for the raffle (from November 15st, 2022 at 00:00 (CEST) and until February 28th, 2023 at 23:59 (CEST).
First prize:

Second prize:
(1) CRUZ merchandising lot:

The Prize may not be subject to any change, alteration or compensation at the request of the Winners.
The Winners may refuse the Prize obtained, but under no circumstances may it be exchanged for an alternative prize, substitute or its cash value. The refusal of the prize does not give right to get any compensation.
The prizes shipping is borne by the company, regardless of the country as long as it is European territory. The Prize may not be subject to any change, alteration or compensation at the request of the Winners.
6. COMPETITION MECHANICS
In order to participate in the Promotion and qualify for the Prize indicated in the PRIZE stipulation, it is necessary that the participants have acquired between the dates of the campaign (between 15/11/2022 and 28/02/2023) any of the following CRUZ ski carriers at any of our online or physical points of sale in the stipulated territorial area:

Participants must fill in all the information on the registration form and attach the proof of purchase (ticket or invoice). The formats pdf, jpg or png will be valid. In any case, the information must be clear and not misleading. Any registration that does not have all the requested fields correctly completed will not be accepted.
During the registration process, each Participant will be assigned a code automatically and randomly. This code will be stored in the CRUZBER database until the moment of the raffle. The raffle will be carried out by means of that code, obtaining a single winner.
The raffle will take place on February 28th, 2023. The Winner will be made public on March 1st, 2023 through CRUZ's social networks and they will be contacted through the email provided in the product registration form. If, after two calendar days since the Winner is made public, it is not possible to contact him/her by any of the channels provided, she/he will lose the right to obtain the Prize and it will be awarded to a Substitute.
CRUZBER informs the Winner that, in accordance with current applicable legislation, the Prize obtained will be considered capital gains not derived from transfers of assets, being subject to direct taxation in the Personal Income Tax - Personal income tax- and being the responsibility of the Winner to comply with their tax obligations.
CRUZBER, if required by current regulations, will carry out and bear withholding on account of Personal Income Tax -IRPF-.
Likewise, CRUZBER will issue the appropriate certification that enables the Winner to comply with their tax obligations. CRUZBER will not be held responsible in any case for the incorrect tax declaration that the Prize Winner may make for this purpose.
The Winner exempts CRUZBER from all responsibility for eventual delays and / or for all types of computer, transport, or logistics incidents (with an enunciative, non-limiting nature) that may occur in compliance with these Legal Bases, whether for reasons derived from a COVID-19 pandemic, force majeure, states of alarm, site, exception, or similar situations, and refuses to request any type of claim and / or compensation against CRUZBER.
7. PERSONAL DATA PROCESSING
CRUZBER will process the personal data collected through this Promotion in compliance with the current law on data protection. The personal data which CRUZBER receives from voluntary Entrants will be included in an automatized file, owned by Cruzber, with address at Pol. Ind. Las Salinas II parcela12, C.P. 14960 Rute (Córdoba), registered in the corresponding Data Protection Agencies and protected with the security measures required by law. The Entrants’ data will be used by CRUZBER with the objective of managing their participation in this Promotion (to contact the winning Entrants and award the Prize), carrying out segmentation activities for strategic and business purposes only, completing tax formalities as well as sending information and commercial offers, through ordinary and electronic means about our products and services and about other companies which belong to the group that we may consider of your interest. Unless stated otherwise, CRUZBER SAU, located at Pol. Ind. Las Salinas II parcela 12, C.P. 14960 Rute (Córdoba), will be responsible for the processing of your personal data. You must address CRUZBER if you wish to exercise your right to access, modify, oppose and cancel your personal data by any of the means established in the current law on data protection.
8. CONSENT FOR USE OF NAME AND ASSIGNMENT OF PUBLICITY RIGHTS
CRUZBER reserves the right to use the name and the image of the Winner in all aspects related to the development of the Promotion. Thus, the Entrants agree to the use, publication and reproduction, all over the world and without limitations, by CRUZBER, of their Image and their name in any type of publicity, promotion publication (Internet included), or any other means, with promotional or informative purposes only and when these are related to the current Promotion. There will not be any financial reward of any type for the Entrants. This agreement may be revoked at any time by the Winner, entitling CRUZBER to compensations for the damages and losses that may result.
9. MODIFICATIONS
In the event of unforeseen circumstances, CRUZBER reserves the right to make changes, cancel, shorten or extend this raffle. CRUZBER commits to give those modifications the same level of publicity as to these Legal Terms and Conditions.
10. ACCEPTING THE TERMS AND CONDITIONS
The participation in this raffle implies the acceptance of all the clauses in these Terms and Conditions as well as the acceptance of the criteria of CRUZBER SAU in the interpretation of these criteria.
11. APPLICABLE LAW AND JURISDICTION
This Promotion is governed by the Spanish law. For any controversy which could result from the interpretation of this document, the parties submit to the jurisdiction of the Courts in Lucena, with express waiver to any other jurisdiction to which they might have recourse.
